Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Postcard platform, operated by Cybertrack Pty Ltd ABN [TO BE ADDED] ("we", "us", or "our"). By accessing or using our platform, you agree to be bound by these Terms.

1. The Platform

Postcard provides a hotel social intelligence platform that enables hotels ("Hotel Partners") to offer guests perks in exchange for social media posts, monitor guest-generated social content, and track the resulting attribution and engagement. Guests access a white-labelled experience operated by the hotel.

2. Accounts and Access

Hotel Partners must create an account to access the platform. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised access at hello@haloeffect.au.

3. Guest Use

Guests access the platform via a link provided by their hotel. By connecting a social media account, guests grant Postcard limited, read-only access to their public profile data as permitted by the relevant social platform. Guests may disconnect their accounts at any time. Guest participation is always voluntary.

All content, trademarks, software, and technology on the Postcard platform are owned by or licensed to Cybertrack Pty Ltd. You may not reproduce, distribute, or create derivative works without our express written consent.

Hotel Partners retain ownership of their own data. By using the platform, you grant us a limited licence to process your data solely to provide the services described in these Terms.

6. Subscriptions and Payment

Access to the Postcard platform for Hotel Partners is subject to a subscription fee as set out in your service agreement. Fees are billed in advance and are non-refundable except as required by Australian Consumer Law. We reserve the right to suspend access for non-payment after reasonable notice.

7. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with these Terms or the platform shall not exceed the fees paid by you in the three months preceding the claim. We are not liable for any indirect, incidental, or consequential loss.

8. Third-Party Services

The platform integrates with third-party services including Instagram, TikTok, YouTube, Stripe, and others. Your use of those services is governed by their own terms. We are not responsible for the availability or conduct of third-party services.

9. Termination

Either party may terminate a subscription by providing 30 days' written notice. We may immediately suspend or terminate access if you breach these Terms. Upon termination, your data will be retained for 30 days and then permanently deleted upon request.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

11. Changes to These Terms

We may update these Terms from time to time. We will provide at least 14 days' notice of material changes via email. Continued use of the platform after changes take effect constitutes acceptance.
